Terms of Service

1. Acceptance
By using Kioku ("the Service"), provided by Caura ("we", "us"), you agree to these terms. If you're using the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. The Service
Kioku provides a managed memory fabric for AI agent fleets, including memory storage, retrieval, MCP connectivity, and a management console. We may update, modify, or discontinue features with reasonable notice.
3. Your Data
You own your data. We do not claim any ownership over the memories your agents store. You grant us a limited license to host, process, and transmit your data solely to provide the Service. We will not use your data to train AI models or share it with third parties except as needed to operate the Service (e.g., embedding generation).
4. Acceptable Use
You agree not to: use the Service for illegal purposes; attempt to access other organizations' data; circumvent rate limits or security measures; store content that violates applicable laws; or reverse-engineer the Service.
5. Plans & Billing
Free plans are subject to usage limits. Paid plans are billed monthly via Stripe. You can cancel at any time; cancellation takes effect at the end of the billing period. We may change pricing with 30 days' notice.
6. API Keys & Security
You are responsible for safeguarding your API keys. Treat them like passwords. Notify us immediately if you suspect unauthorized access. We are not liable for damages caused by compromised API keys on your end.
7. Availability
We aim for high availability but do not guarantee 100% uptime. The Service is provided "as is" without warranty of any kind. Enterprise plans include SLA guarantees — contact sales for details.
8. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your account for violation of these terms. You may delete your account at any time. Upon termination, your data will be deleted within 30 days unless a legal hold applies.
